Terms of Service — House of Livora

1. Acceptance of Terms

Welcome to House of Livora, a curated multi-brand marketplace operated by Vinayak Garments ("House of Livora," "we," "us," "our"). By accessing or using our website, mobile experience, or services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use our platform.

We operate globally and serve customers across multiple countries. By using our services, you agree that these Terms apply regardless of your location, subject to any mandatory local consumer protection laws that may override specific provisions.

2. Who We Are

House of Livora is a curated marketplace that connects customers with independent, vetted, sustainable and slow-fashion brands. We do not manufacture most products sold on the platform — we facilitate the sale between you (the customer) and the brand ("Brand Partner") whose product you purchase, unless explicitly stated that an item is sold directly by House of Livora.

3. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account or make a purchase on House of Livora. By using our platform, you confirm that you meet this requirement.

4. Account Registration

• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate, current, and complete information during registration and to update it as needed.
• You are responsible for all activity that occurs under your account.
• We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

5. Products, Listings & Pricing

• All product descriptions, images, and pricing are provided by Brand Partners and displayed in good faith. While we vet every brand before onboarding, we do not guarantee that product descriptions are error-free.
• Prices are listed in [insert currency, e.g. INR/USD] and are subject to change without notice. Applicable taxes and duties (for international orders) will be calculated at checkout.
• We reserve the right to limit quantities, refuse orders, or cancel orders at our discretion — including in cases of pricing errors, suspected fraud, or stock unavailability. If your order is cancelled after payment, you will receive a full refund.

6. Orders & Payment

• All payments are processed securely through Razorpay. House of Livora does not store your complete card, UPI, or banking information.
• An order is confirmed only once payment is successfully authorized.
• For international orders, currency conversion and any applicable customs duties or import taxes are the responsibility of the customer, unless otherwise stated at checkout.

7. Shipping & Delivery

• Estimated delivery timelines are provided at checkout and may vary depending on the Brand Partner's location, your shipping address, and courier availability.
• House of Livora is not liable for delays caused by customs processing, courier disruptions, or circumstances beyond our reasonable control (see Section 12, Force Majeure).
• Risk of loss and title for products pass to you upon delivery to the shipping carrier, except where local law provides otherwise.

8. Returns, Refunds & Cancellations

Returns and refunds are governed by our separate [Return & Refund Policy], which forms part of these Terms. In summary:

• We accept returns/refunds/replacements only for damaged or defective items, wrong items shipped, or late delivery with valid proof.
• Certain categories (intimate apparel, cosmetics, jewelry, custom/personalized items, and final sale items) are non-returnable except where the item itself is defective or incorrect.

9. Brand Partner Relationship

• Brand Partners listed on House of Livora are independent businesses that have passed our sustainability and quality vetting process.
• While we curate and vet every Brand Partner, each Brand Partner is independently responsible for the accuracy of their listings, product quality, and fulfilment of orders placed through our platform.
• House of Livora acts as a facilitator of the transaction and marketplace infrastructure (payments, order management, customer support coordination) between you and the Brand Partner.

10. Intellectual Property

All content on House of Livora — including our logo, design, text, graphics, and platform software — is owned by or licensed to House of Livora / Vinayak Garments and protected under applicable intellectual property laws. Brand Partner content (product images, descriptions, brand names) remains the property of the respective Brand Partner. You may not reproduce, distribute, or use any content from this platform without prior written permission.

11. User Conduct

You agree not to:

• Use the platform for any unlawful purpose
• Submit false, misleading, or fraudulent information
• Attempt to interfere with the security or functioning of the website
• Scrape, copy, or resell content or products from the platform without authorization
• Post abusive, defamatory, or harmful content in reviews or communications

We reserve the right to remove content or restrict access for violations of this section.

12. Limitation of Liability & Force Majeure

To the fullest extent permitted by law:

• House of Livora is not liable for indirect, incidental, or consequential damages arising from your use of the platform or products purchased through it.
• We are not responsible for delays or failures in performance caused by events beyond our reasonable control, including natural disasters, customs delays, courier disruptions, strikes, or government restrictions ("Force Majeure").
• Our total liability for any claim arising from your use of the platform shall not exceed the amount you paid for the relevant order.

Nothing in these Terms limits any liability that cannot be excluded under applicable law, including certain consumer protection rights in your jurisdiction.

13. Indemnification

You agree to indemnify and hold harmless House of Livora, Vinayak Garments, and our affiliates, officers, and employees from any claims, damages, or expenses arising from your violation of these Terms or misuse of the platform.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of Indore, India, except where local mandatory consumer protection laws in your country of residence provide you with rights to bring a claim in your local courts.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified via the website or email where appropriate. Continued use of the platform after changes take effect constitutes acceptance of the updated Terms.

16. Termination

We reserve the right to suspend or terminate your access to House of Livora at our discretion, including for violation of these Terms, without prior notice, where permitted by law.
